Please read these Terms of Use (“Terms”) carefully before using the website https://romania-tours.travel (the “Website” or “Service”) operated by Oak Tree Travel SRL (“we”, “us”, or “our”), a Romanian company with tourism license [insert your license number here, e.g., from Ministry of Tourism / ANT].

1. Acceptance of Terms

Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Website, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.

2. Intellectual Property

The Website and its original content, features, and functionality (including text, graphics, logos, images, and software) are and remain the exclusive property of Oak Tree Travel SRL and its licensors. They are protected by Romanian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

3. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services you visit.

4. Provision of Tourism Services

Oak Tree Travel SRL is a licensed Romanian travel agency offering tourism services, including guided tours, transportation, accommodation bookings, and related travel arrangements (“Services”). All information on the Website is for general informational purposes only and does not constitute a binding offer. Detailed terms, scope, itinerary, pricing, cancellation policies, and other conditions are set out in the individual contract (booking confirmation, voucher, or signed agreement) concluded with each client. The individual contract supersedes any general information on the Website.

5. Pre-Contractual Information and Insolvency Protection

In compliance with Romanian law (OUG nr. 2/2018 transposing EU Directive 2015/2302 on package travel and linked travel arrangements), before concluding any contract for package travel or linked travel arrangements, we provide key pre-contractual information, including:

  • Main characteristics of the travel services (destination, itinerary, duration, accommodation type and category, transport details, meals);
  • Total price (including taxes, fees, and any additional costs);
  • Payment terms and deposit/full payment requirements;
  • Cancellation, termination, and amendment rights and penalties;
  • Passport, visa, health, and safety requirements;
  • Contact details for assistance during the trip;
  • Insolvency protection details.

We hold compulsory insolvency protection insurance issued by Omniasig Vienna Insurance Group (policy details available on request or via our Insurance page: https://romania-tours.travel/insurance). This covers reimbursement of payments made and, where relevant, repatriation in case of our insolvency or bankruptcy, as required by law.

6. Booking, Payment, Pricing, Amendments, and Cancellations

Bookings are confirmed only upon our written acceptance and receipt of the required deposit or full payment as specified in the individual contract. Prices displayed on the Website are indicative and subject to change until the contract is confirmed. The final price is that stated in your individual contract. Amendments, cancellations, refunds, and any applicable penalties are governed exclusively by the terms in your individual contract (which may include standard scales based on timing and notice period).

7. Liability and Disclaimers

Services are provided with reasonable skill and care in accordance with Romanian law. However:

  • We are not liable for delays, changes, cancellations, or failures caused by circumstances beyond our reasonable control (force majeure, including weather, strikes, government restrictions, pandemics, third-party supplier issues, etc.).
  • We recommend that all clients obtain comprehensive travel, medical, and cancellation insurance. Clients are responsible for their personal health, safety, and compliance with entry requirements.
  • Our liability for any proven direct damages arising from our Services is limited to the total price paid for the relevant package/service, except in cases of willful misconduct or gross negligence. We exclude liability for indirect, consequential, or punitive damages to the extent permitted by law. The Website is provided “as is” and “as available” without warranties of any kind (express or implied), including uninterrupted access or error-free operation.

8. Termination

We may terminate or suspend your access to the Website immediately, without notice or liability, for any reason, including breach of these Terms. Provisions that by nature should survive termination (e.g., intellectual property, liability limitations, governing law) will continue in effect.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of Romania, without regard to conflict of laws principles. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts in Sibiu (or Bucharest, as applicable). As a consumer, you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/odr or contact a Romanian Alternative Dispute Resolution entity.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be notified on the Website with at least 15 days’ notice where feasible. Your continued use after the effective date constitutes acceptance of the revised Terms.
